Terms of Service

Welcome to Savvy Jetsetter. These Terms of Service ("Terms") govern your access to and use of the website, applications, and services located at https://savvyjetsetter.ca (collectively, the "Service"), operated by Savvy Jetsetter, based in Ontario, Canada.

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, whether or not you are a registered user. These Terms constitute a legally binding agreement between you and Savvy Jetsetter.

If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

Savvy Jetsetter is an AI-powered travel planning platform that allows users to:

• Generate personalized travel itineraries using AI based on inputs such as destination, dates, budget, and interests.
• Browse destination guides, trip templates, and curated travel content.
• Purchase digital travel guides and itinerary upgrades.
• Submit inquiries for full-service travel consultations with a certified travel advisor.
• Save and manage itineraries through a personal dashboard.
• Sign in using supported social media accounts and share travel content to connected social platforms where permitted.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding contract.

The Service is not intended for use by children under 16. If we become aware that a user under the age of 16 has registered an account, we will suspend and delete the account immediately.

4. User Accounts

To access certain features of the Service, you may need to register for an account. When you register, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information to keep it accurate.
• Maintain the confidentiality of your account credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized access or security breach.

You may not use another user’s account without permission, create multiple accounts to evade restrictions, or sell, trade, or transfer your account to another person.

5. Social Media Login & Integrations

The Service supports authentication and integration with third-party social media platforms including TikTok, Google, and others. When you choose to sign in using a social media account:

• You authorize us to access limited profile information (such as display name and avatar) from that platform, as permitted by the scopes you grant.
• Your use of the social login feature is also subject to that platform’s own terms of service and privacy policy.
• You may disconnect a linked social media account at any time from your account settings.

The Service may also allow you to share travel content (such as itinerary highlights, photos, and destination videos) to your connected social media accounts. By using these sharing features, you grant us permission to post content on your behalf strictly at your direction. You remain fully responsible for any content you choose to share and must ensure it complies with the rules of the destination platform.

We are not responsible for any changes to, suspension of, or termination of third-party social media platforms or their APIs.

6. User Content & Conduct

"User Content" means any information, text, images, itineraries, inquiries, or other material that you submit, upload, or generate through the Service. You retain ownership of your User Content, but by submitting it you grant Savvy Jetsetter a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that your User Content does not violate any law, infringe any third-party rights, or breach these Terms.

7. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Post or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, hateful, or racially, ethnically, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or any connected systems or networks.
• Use any automated system, including bots or scrapers, to access the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service or any AI models used by the Service.
• Use the Service to develop a competing product or service.
• Spam, harass, or engage in fraudulent activity through the Service.

8. Payments, Credits & Refunds

8.1 Pricing

Certain features of the Service require payment, including but not limited to Trip Pass upgrades, credit packs, digital travel guides, and subscription tiers. Current pricing is displayed on the Service and may be updated from time to time.

8.2 Payment Processing

All payments are processed by Stripe, a third-party payment processor. By making a purchase, you agree to be bound by Stripe’s terms of service. We do not store your full payment card details on our servers.

8.3 Credits

Credits purchased through the Service are non-transferable and have no cash value outside of the Service. Credits do not expire while your account remains active but will be forfeited if your account is terminated for breach of these Terms.

8.4 Refunds

Due to the digital nature of the Service, all purchases are generally non-refundable once delivered. Exceptions may be granted at our discretion for technical failures or in accordance with applicable consumer protection laws. To request a refund, contact us at info@savvyjetsetter.ca within 14 days of purchase.

9. AI-Generated Content

The Service uses artificial intelligence (including Anthropic’s Claude) to generate travel itineraries, destination guides, and other content based on your inputs. You acknowledge and agree that:

• AI-generated content is provided for informational and inspirational purposes only and does not constitute professional travel, legal, medical, financial, or safety advice.
• AI outputs may contain errors, omissions, or outdated information, and should always be independently verified before acting on them.
• You are solely responsible for verifying visa requirements, health advisories, travel restrictions, venue availability, and pricing before making any travel arrangements.
• We make no warranty that AI-generated content will be accurate, current, complete, or suitable for your particular needs.

10. Intellectual Property

All content on the Service not owned by users — including but not limited to the Savvy Jetsetter name, logo, branding, website design, graphics, text, software, and the compilation of all content — is the exclusive property of Savvy Jetsetter or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

11. Third-Party Services & Links

The Service may contain links to or integrations with third-party websites, applications, or services (such as hotel booking platforms, social media platforms, and payment processors). These third parties are not under our control, and we are not responsible for their content, privacy practices, or policies.

Your use of third-party services is at your own risk and subject to the terms and policies of those third parties. We encourage you to review them before engaging with any third-party service.

12. Disclaimers & Travel Advisory

To the fullest extent permitted by law, Savvy Jetsetter disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any AI-generated content, travel information, or recommendations.

Savvy Jetsetter is not a licensed travel agency with respect to AI-generated itineraries. While Savvy Jetsetter is a certified travel advisor affiliated with Fora Travel, the automated itinerary generation tools do not create an advisor-client relationship. A formal advisory engagement requires separate written agreement.

You are solely responsible for verifying all travel information including visa requirements, entry conditions, health and vaccination requirements, travel advisories, safety conditions, and availability before travel. We strongly recommend purchasing comprehensive travel insurance.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Savvy Jetsetter, its owner, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to:

• Your access to, use of, or inability to use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service, including AI-generated itineraries.
• Unauthorized access, use, or alteration of your transmissions or content.
• Travel disruptions, cancellations, injuries, illnesses, or losses of any kind during or related to travel.

In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability is limited to the maximum extent permitted by law. In no event shall our total aggregate liability exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) CAD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Savvy Jetsetter, its owner, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service.
• Your violation of these Terms or any applicable law.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any User Content you submit or any action you take using the Service.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at info@savvyjetsetter.ca. Sections of these Terms that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) will survive.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or your use of the Service shall be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of Ontario, Canada.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will notify registered users by email at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
